Two major nurses associations are applauding the Trump administration’s move to federally reschedule marijuana, which they say will pave the path for expanded research into the potential health benefits of cannabis if the rule is finalized. Representatives of AANA, meanwhile were invited to attend the signing ceremony in the Oval Office when Trump issued the cannabis order. The association’s president, Jeff Molter, said in a statement that “reclassification will expand opportunities for rigorous research into how cannabis and cannabinoids can provide pain relief, and how they interact with anesthesia and perioperative care, strengthening the science that underpins patient safety.” Certified nurse anesthetists “have been leaders in this important research, and this will open the door to more opportunities,” he said. “The AANA thanks the Trump administration for this important action which will prioritize patient safety and research, and we look forward to partnership with federal agencies and the clinical community to ensure implementation supports safe, high-quality anesthesia care.” Other healthcare groups, including the American Pharmacists Association (APhA), have also promoted the rescheduling move, similarly describing it as a policy change that will bolster future research into cannabis. With rescheduling now moving forward, some key House and Senate members recently previewed their priorities for additional reform—from giving cannabis businesses access to the banking system to legalizing marijuana altogether. Lawmakers in states like Pennsylvania and Tennessee have also said that the political effect of federal rescheduling could ultimately help as they work to enact local reforms in the next year.   6. In the days since President Donald Trump signed an executive order on marijuana rescheduling this month, there’s been some misreporting that the deal is officially done. But as congressional researchers note in a new report, the reclassification must still be finalized—and there’s a chance the Justice Department could opt to start the process all over again, or even not complete it at all. What the president did through executive action was direct the attorney general to expeditiously complete the process of moving cannabis from Schedule I to Schedule III of the Controlled Substances Act (CSA), in accordance with a proposed rule initiated under the Biden administration. Short of that sign-off, marijuana still remains a Schedule I drug. “At the time the executive order was issued, the agencies had not taken final action on the proposed rescheduling, and it remains to be seen whether and when they will do so,” the Congressional Research Service (CRS) said in an analysis published last week. “It remains to be seen whether DOJ will take final action to reschedule marijuana and, if so, when and how the agency will act.” So far, the Justice Department has been silent on potential next steps. Attorney General Pam Bondi did not appear at Trump’s signing ceremony for the cannabis executive order. And DOJ has not responded to repeated requests for comment from Marijuana Moment. That’s not necessarily indicative of resistance to the president’s directive, especially considering that the department is dealing with unrelated controversies such as the disclosure of files associated with Jeffrey Epstein. But without DOJ input on the rescheduling issue since Trump signed the order, questions have arisen as to how the order will be executed and how long the process will take. “DOJ could potentially finalize the May 2024 proposed rule or issue a new proposed rule,” CRS said in the new report. The president “cannot directly change the status of marijuana under federal controlled substances law but can direct executive agencies to consider rescheduling marijuana, as President Trump did in the December 2025 executive order.” As in past reports on rescheduling, the independent agency’s analysis notes that the classification of cannabis can be altered by either the executive branch or Congress. “If Congress seeks to change the legal status of marijuana, it has broad authority to do so before or after [the Drug Enforcement Administration, or DEA] makes any final scheduling decision,” CRS said, adding that there have been attempts in recent sessions to pass legislation to reschedule or legalize marijuana altogether. Either reform “could raise additional legal questions,” however, it said. For example, the Food and Drug Administration (FDA) currently regulates certain cannabinoid-based prescription drugs, so it’s possible that legislators may work to create a broader regulatory framework for marijuana. “While most recent proposals would relax federal regulation of marijuana, Congress could also seek to impose more stringent controls,” the report continues, pointing to GOP-led bills to continue to prevent cannabis businesses from taking federal tax deductions even if the plant is rescheduled. The tax parity impact of moving marijuana to Schedule III is one of the more significant reasons industry stakeholders have been pushing for the incremental reform, even if it doesn’t immediately legalize cannabis. Extend the implementation timeline for the hemp ban.” By Adam Terry, Cantrip As was widely reported to be imminent, last week just about the entire cannabis universe watched President Donald Trump sign an executive order to reschedule marijuana from Schedule I to Schedule III. What was not as widely reported was what Trump also did: He directed lawmakers to legislate again on the new definition of hemp as passed by Congress last month. The specific text from the executive order reads: “The Assistant to the President and Deputy Chief of Staff for Legislative, Political, and Public Affairs shall work with the Congress to update the statutory definition of final hemp-derived cannabinoid products to allow Americans to benefit from access to appropriate full-spectrum CBD products while preserving the Congress’s intent to restrict the sale of products that pose serious health risks…” This provision is careful and specific. It directs a deputy chief of staff to work with Congress to update the new definition of hemp in direct recognition of what the hemp industry has been saying for weeks now: Full-spectrum CBD products are not possible under this new language. It acknowledges specifically that if CBD products are to be subsidized or covered by Medicare, as is part of Trump’s plan, those products will be derived from hemp. Full-spectrum CBD is crucial to many Americans. It is a lifeline for veterans and seniors who rely on these products for a variety of therapeutic purposes. It is a crucial element for some with epilepsy, including pediatric patients. I have had mothers and fathers message me expressing that Epidiolex, a federally approved CBD prescription drug, simply did not work for their kids—and instead they relied on other CBD products to find relief for their children. This is not just politics for them, but a stark reality. You cannot have full-spectrum CBD with only 0.4mg of THC per container, as is required under the newly enacted change to the federal definition of hemp, and the president recognized this in his executive order—I’m sure with the counsel of groups like the Commonwealth Project who were present at the signing. Because of this, the definition of hemp is very likely to be reopened and legislated once more. So here’s the point: This conversation will take time, and likely more than is left for hemp ahead of the ban set to be enacted late next year. In the nearly three years I’ve been working with the New Jersey legislature to craft a bill to regulate hemp cannabinoids in a way that doesn’t decimate the CBD market, no law at the time of this writing has yet managed to take full effect in the state because of this complexity. This means that the best, first step Congress must take is to extend the deadline for the implementation of the revised hemp definition in order to ensure full spectrum CBD access remains for the tens of millions of Americans who will lose access next November should this language take effect. With 2026 being a tight election year, most legislation will be slowed to a crawl after April, and so it is unlikely that a final bill updating this language and regulating hemp cannabinoids could make it over the finish line until the next Congress beginning in January 2027. And the extension must pass soon, as farmers cannot plant in the spring if their crop will be a crime come harvest time. I look forward to the ensuing conversation. Hemp must be regulated in this country, that is clear. The White House just sent a signal that the prohibitionist redefinition cannot stand if we are to do right by the people who rely on cannabis the most, particularly across the red states that voted for this president and have no access to cannabis outside of hemp products. Congress, you have your marching orders from the president. Extend the implementation timeline for the hemp ban, and let’s do the real, hard work to craft legislation that enshrines safe access to cannabis for Americans across this great nation.
